Alright, i'm not banned but there are a few games i would like to use with the tunneling service. What i'm wondering is if i setup a static IP for my 360 then forward

They detect backups regardless of the ports being open or not. The ports are only needed for the NAT on xbl to be open.

so are you saying that if you try to play a backed up version of halo3 live , then M$ will ban your xbox360 ?

They might not ban you right away, but if they keep doing it as they have been all this time, you will eventually get banned.

They ban your console ID and NOT your IP.
And there is no way to hide this from them if you sign in to xbox live since it is used for the encryption of the kerberos login procedure...
And just to clarify this and to prevent confusion, Microsoft cant detect backups in general, they ban you for playing bad backups.
If you have improper stealth information like a corrupt security sector or so they will log it and put you on the pending ban list.
On special days they do then randomly take names from this list and ban people.
People dont get banned as soon as a bad backup is detected, Microsoft bans in waves...

This information is not confirmed but this is what the major part is assuming Microsoft to ban people for.

There is no way they can see if you're using any of them. However, if you are signed in to Live while you do it, the bad backup thing is still on.

And btw, I wouldn't recommend using any of those, as they are IMHO not worth the effort.

They are worth the effort if you use them only to play with local people.
However if you are playing with people from other countries you will most likely get problems because of the ping limit(60ms was the maximum if I remember right...)
