If FBA is released under an agreement similar to the old MAME license, it might have a provision stating that it violates the agreement to distribute a binary with support for games newer than (insert year or number of years here). It's largely not enforcable of course, but in the case of distribution of illegal XDK derived software, the prime distributers of such software could choose to honour the license.
